Judge finds TrueAllele reliable in Cleveland Daubert challenge

On April 13, Cuyahoga County Common Pleas Judge Michael Shaughnessy denied a defendant's motion in limine to exclude TrueAllele^® evidence. This is the DNA analysis technology's sixteenth favorable ruling in sixteen Frye or Daubert challenges.

The Ohio court found that "TrueAllele has been extensively tested" and "has been subjected to peer review." Moreover, "TrueAllele has a known or potential error rate, which was documented in ... Cuyahoga County validation studies."

The Cuyahoga County prosecuting attorneys were Jeffrey Schnatter, Katherine Mullin and Kristen Hatcher. The testifying TrueAllele scientists were Dr. Nasir Butt and Christine Scott of the Cuyahoga County Regional Forensic Science Laboratory, and Dr. Mark Perlin of Pittsburgh-based Cybergenetics.

"TrueAllele is the only fully Bayesian solution to the DNA mixture problem," said Dr. Perlin. "Computing accurate and objective match statistics provides scientific truth for better justice."
